Agreement

featuremessage (the "Service") is provided by Andreas Losing ([email protected]). By creating an account, purchasing a plan, or otherwise using the Service, you agree to these Terms. If you disagree with any provision, please stop using the Service.

Service Overview

The Service allows you to write and schedule messages (text and video) to be delivered to yourself or others at a future date. Messages are delivered via email at the scheduled time. You are responsible for the content you create and for ensuring you have the right to send messages to any recipients you specify.

Plans & Payments

We offer a free tier with limited features and a Pro plan as a one-time payment. The Pro plan includes unlimited messages, video support, and a fixed storage quota (currently 500MB). Pricing and features are shown at checkout and may change for future purchases. Payments are processed through Polar and are non-refundable once completed, except where mandatory consumer law grants additional rights. We may suspend access for fraud or abuse.

Pro Access

Pro access means you may use the Service for as long as we continue to operate it. If we decide to discontinue the Service, we will make reasonable efforts to deliver all your scheduled messages before shutdown. No refunds or compensation are provided upon discontinuation.

Accounts & Security

Keep your details accurate, protect your login, and tell us about unauthorized use. Each account is for one person; reselling or sharing without consent is not allowed.

Acceptable Use

Do not use the Service to send spam, harass others, or distribute unlawful, harmful, or infringing content. Do not bypass security, overload our systems, or scrape data. We reserve the right to remove content or suspend accounts that violate these rules.

Data & Privacy

Andreas Losing is the data controller for personal data processed through the Service. Details about data handling and user rights are described in our Privacy Policy. Contact [email protected] for GDPR requests or data processing inquiries.

Intellectual Property

The Service, including all software, branding, and content, remains our exclusive property. You receive a limited, non-transferable license to access it for your own personal use. You retain full ownership of the messages and videos you create. We do not read, analyze, or use your content for any purpose other than storing and delivering it as you instructed. We only access your content when required by law or to investigate abuse.

Third-Party Links

The Service may link to third-party websites or tools. We do not control or endorse them and are not responsible for their content, availability, or policies. You use them at your own risk.

Disclaimers

The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee error-free delivery, uninterrupted availability, or that messages will arrive at the exact scheduled time.

Limitation of Liability

To the fullest extent permitted by law, our total liability arising out of or in connection with the Service is limited to the fees you paid to us. We are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, revenue, data, or goodwill.

Indemnity

You agree to indemnify and hold us harmless from claims, damages, liabilities, and expenses arising from your breach of these Terms, use of the Service for unlawful purposes, or infringement of third-party rights.

Termination

We may suspend or terminate access with notice if you materially breach these Terms or create risk for other users. You may terminate by deleting your account. Upon termination, your license ends and we may delete data retained in your account after statutory retention periods lapse.

Changes

We may revise these Terms at any time by posting an updated version and revising the "Last updated" date. Continued use after the update means you accept the new Terms. If you disagree, stop using the Service.

Governing Law

These Terms are governed by German law. Mandatory consumer protections of your home jurisdiction remain unaffected.
